Courts order Apple to end e-books pacts

Apple Inc., the world's biggest technology company, should be ordered to cancel existing agreements with five publishers after a judge's ruling that it conspired to fix prices of electronic books, the Justice Department said Friday.

The federal government and 33 states submitted the proposal in U.S. District Court in Manhattan. They called for a court-appointed antitrust compliance monitor and a requirement that Apple allow competitors to provide links from their e-book applications to their electronic bookstores.

Friday's proposal would require Apple to find a new way to do business with publishers.

"From a financial standpoint, this means nothing for Apple," John Bright, an analyst with Avondale Partners, said in an interview. "But strategically speaking it is a setback. I think Apple would now have to find different work- around solutions for pricing. They would use the same publishers but they would have to negotiate different solutions."

U.S. District Judge Denise Cote, after a nonjury trial in Manhattan, ruled July 10 against Apple. The company now faces another trial on damages. The proposal submitted today needs court approval to become effective.

"Under the department's proposed order, Apple's illegal conduct will cease and Apple and its senior executives will be prevented from conspiring to thwart competition in the future," Bill Baer, the assistant attorney general in charge of the antitrust division, said in a statement.

"The idea behind this proposal would certainly make the e- book industry more competitive," Bright said. "By definition, increased competitiveness in an industry leads to lower prices."

The U.S. sued Apple and five of the biggest publishers in April 2012, claiming that the technology company pushed publishers to allow it to sell digital copies of their books under a model that raised prices and harmed consumers.

Under that so-called agency model, publishers, not retailers, set book prices, with Apple getting 30 percent.

The publishers ? Verlagsgruppe Georg von Holtzbrinck's Macmillan unit, CBS's Simon & Schuster, Lagardere's Hachette Book Group, Pearson's Penguin unit and News Corp.'s HarperCollins ? settled with the government. Continued...

Under the Justice Department plan, the salary and expenses of the proposed external monitor would be paid by Apple. The person would work with an internal antitrust compliance officer who would be hired by and report to the outside directors on Apple's audit committee.

The government's proposal extends to media other than electronic books. It would prohibit Apple from entering agreements with suppliers of music, movies, TV shows and other content if those deals are likely to increase the prices at which their competitors sell them.

Tom Neumayr, a spokesman for Cupertino, Calif.-based Apple, declined to comment on the proposal.

A hearing on the proposal will be held Aug. 9.

Ashton Kutcher Chokes Up Talking About Steve Jobs On 'The Tonight Show' (VIDEO)

Ashton Kutcher proved his passion for the role of Steve Jobs in the upcoming biopic, "Jobs," during his appearance on "The Tonight Show. He even seemed to choke up while talking about the role, and a big regret he had related to the man he was portraying on the screen.

Kutcher said that about six months before Jobs died, he had an opportunity to meet him. "I was working that day and couldn?t go, and in hindsight I look back and think, I had the opportunity to meet the Leonardo DaVinci of our generation, and I missed it," Kutcher lamented.

He said that incident weighed on him, and affected his decision to take on the role. "I?ll never forget the moment I heard that he died," Kutcher said. "I realized I?d taken him for granted, and taken for granted the contribution that he actually gave to society, and I actually had a real emotional moment.?

To take on the role of someone he admired so much, Kutcher said he studied Jobs' walk, stare, diet and emotions. He even fired his own employees to emulate Jobs.

Fans can see his take when "Jobs" hits theaters on August 16. Some critics think the movie doesn't dig deep enough, but most seem to agree that Kutcher does well in the role.

In keeping with the spirit of Steve Jobs and his visionary nature when it came to technology, "Jobs" became the first movie trailer ever to be on Instagram.

What is it like to be Muslim in Congress?

Keith Ellison stands out on Capitol Hill.

The Minnesota Democrat is the first Muslim elected to Congress, and now is only one of two. He leads a progressive caucus in a Republican-controlled House of Representatives. And he?s not afraid to break out the guitar that he keeps in his office, even playing a few chords of a song for his interview with ?The Fine Print.?

When it comes to his religion, Ellison says his fellow members of Congress have generally been respectful but that there have been ?a few crazy incidents.?

?Recently, you know, a member said Muslim Americans are not condemning terrorism enough,? Ellison says, referring to a comment made by Rep. Mike Pompeo, R?Kan., that implied that Muslims were being ?potentially complicit? in acts of terror if they did not speak out against them.

?And I said, 'well, let me guarantee you, Muslims are condemning terrorism every day all the time ...' and I gave him a whole list, and he said, 'Thanks for telling me, I didn't know, I won't be saying that again,'? Ellison says.

As Muslims across the world celebrate the month of Ramadan, Ellison says he doesn?t ?agonize? over fasting from sunrise to sunset in observance of the month considered holy in Islam.

?Ramadan is a wonderful time of year for me,? Ellison says.? ?It?s the time to reflect. ... Your hunger is supposed to remind you that there are people who are fasting involuntarily all over this world.?

But in order to keep up with his busy Congressional schedule, Ellison says he does try to limit his physical activity.

?I think what you do is you dial your energy level back just a tad,? he said. ?Instead of running, you walk -- you know, stuff like that.?

Ellison, who was elected in 2006, is among the most progressive members of Congress and serves as co-chairman of the Congressional Progressive Caucus.? He says he?s proud of the progressive issues that President Obama has been able to accomplish during a time of deep divisions on Capitol Hill.

?People wanted to do comprehensive health care and this president got it done,? Ellison says. ?This president speaks up for a increase in the minimum wage, and is a real champion of immigration reform.?

Asked if Obama has been enough of liberal, Ellison replies that he instead views him as a centrist.

?You look at poll data and things that are considered liberal that Americans want by large margins: background checks on gun purchases ... raise the minimum wage,? Ellison says. ?All types of things that the American people are very strongly in favor of in large numbers, uh and ... for him to say he wants those things is a centrist position.?

After all 5,000 Ubuntu Edge smartphones sold out on their lowest $600 Indiegogo pricing tier, Canonical has added three new lower pledge levels. Initially, those who missed out on the one-day-only offer would've needed to cough up $830, but there are now $625, $675 and $725 rungs prior to that price, each with 1,250 of the linux-coated handsets available. Meanwhile, the counter at the original $830 second level -- which had already been in the hundreds -- has been reset, with Canonical promising it would "refund the difference at the end of the campaign so you won't lose out." That presumably means it's moved those buyers to a lower tier, but it promised to contact them directly with more information. We're not sure if a slowdown in pledges on the $32 million campaign provoked the move, but we've reached out to Canonical for more information.

Oil price falls

NEW YORK

Oil fell Monday after the U.S. government said sales of previously occupied homes dipped in June.

Meanwhile, the average price of gasoline in the U.S. stayed at $3.67 a gallon over the weekend after rising steadily for two weeks.

Benchmark crude oil dropped $1.14 to finish at $106.91 a barrel on the New York Mercantile Exchange.

Sales of previously occupied homes in the U.S. slipped 1.2 percent in June to a seasonally adjusted annual rate of 5.08 million. Any sign that the U.S. economic recovery is slowing can depress oil prices.

Oil is still up more than $13 a barrel since June 21, underpinned by sharp declines in U.S. stockpiles and concerns of supply disruptions in the Middle East.

Some analysts, however, say the fundamental rules of supply and demand alone do not justify the rise, and speculators also are pushing the price higher.

?While crude-oil stocks have declined for three weeks in a row, fundamentals in the gasoline and distillates markets appear less supportive,? said a report from JBC Energy in Vienna. ?Stock levels for oil products are in line or above the five-year average, and domestic demand is anything but impressive.?
